Seller did not perform
I was scheduled to close on a SFH last Monday. I requested an additional two days as the home inspection did not come back until the Saturday morning before closing. The seller did not sign an addendum to extend the close. On Wednesday I wired my funds to the title company and sent in my closing package. Since then, the seller has decided not to sell. I have a balance with the title company and have spent aroun $800 on due diligence (home inspection, etc). The realtor (who represents both parties) is recommending that I sign a mutual release and that the seller reimburse me for $168 for 1/2 of the title cost. What are my rights here? Does missing the closing date mean that I have no real leverage? I'm not necessarily looking to force specific performance, but would like to know what the sellers obligations are before negotiating. Any advice is appreciated.
