Cancellation of contract - deposit in question

In the state of California....

We have a cancellation signed by both parties. Both buyer and seller agree to cancel, but do not agree on who deposit will be released to.

In this case, if both parties mutually agree to cancel the contract but deposit remains in question, can the seller get another buyer into contract on the same house?
