Trouble closing on my parents house

Dan Fendius
Posted

Hey Everyone,

My parents are having issues with the closing of their house and had a question. Any help is greatly appreciated!

"Contract to sell house was signed with a contingency that the buyers sell their house. There was $15k in Ernest money, with $7500 of the $15k guaranteed. Closing was delayed via amendment by the buyer and rescheduled due to issues with closing on their current home. The amended closing was not met and buyer exercised the Unilateral extension of 8 days which, due to a Friday close date and a holiday was actually 11 days. The closing did not happen on the 11th day. If the seller agrees to extend the closing again, do they get the $7500 in Ernest money or is that only payable if they do not agree to extend?"
