Developer Buyer wants to buy months after closing date. Thoughts?
Received word that developer buyer still wants to buy but 6 months months past closing date. Atty said best to negotiate bc the next step would be to issue a Time of Essence, which buyer would delay until they were ready to buy anyway. Atty said I cant cancel and say buyer is in default because they haven't missed a closing. This is for NY property. I just can't believe that 6 months isn't considered unreasonable and therefore cancels the contract. Anyone have this happen to them?
