How can I get around "Broken Priority" in New Mexico??

I'm currently under contract for raw land in New Mexico and I'm wondering if there is a way to get around "Broken Priority" when I go to get a construction loan a couple years down the line. I plan to clear a driveway and space for a trailer to live in for a couple years while I raise capital for financing a construction loan for a home. I have several questions that have not been clearly answered by the ladies at the real estate office; such as, 

Who is charging these fees if I have broken priority? 

Can I demonstrate that I do not owe any money for work that I've done? 

What are my options if I want to live on the land for a while before building?

Any and all information one may have on the subject of buying, building, or living on raw land in New Mexico would be greatly appreciated. Thanks
