Having the deed and the mortgage in different names East CLV

Hi my name is Mendel I am 22 year's old, I'm working on my first deal, it's in East Cleveland (Yes I know it's not the greatest area but I don't have the money to invest in the nicer places and instead of continuing my 2 year search for investors I decided just to do the deal by myself) The property is a Duplex which needs about$10,000 of work in it to make it section 8 ready, each unit can rent from $600-800 a month. The seller has a $28,000 mortgage on the house and wants to do a creative finance deal. He wants me to pay him $12,000 up front and then I will take over the mortgage payments without assuming the mortgage, but the deed will transfer into my name. Had anyone had a deal like this? How did it turn out? Is it even legal?
