Delayed closing because of HOA insurance oversight
I was scheduled to close on a townhouse on March 20th. Both the seller and buyer (me) had the documents etc necessary for the close to happen. However upon approval of the buyer's mortgage, the mortgage company uncovered that the HOA did not have proper insurance to abide by federal requirements. The HOA / management company / insurance company has proceeded to drag their feet in getting the required insurance and documentation. Meanwhile, I am forced to spend $78 per night while they figure out this issue. The delay was / is because of the HOA's failure to have federally required insurance. I requested that the living expenses I incur be taken out of future HOA dues, given that this is their oversight. Do I have an legal recourse options here?
