Trustees Notice of Sale
If a trustees notice of sale has been posted can I still approach the tenant with an offer so they can avoid foreclosure or is it already in the hands of the lending company and I would have to wait to make an offer at auction?

The owner still owns the home and can sell the property to satisfy the mortgage until the day of the auction.
Whether you can approach the owner is state dependent. Some states, like Washington, don't allow you to approach a distressed homeowner unless you are a real estate agent, attorney, loan officer or certified loan modification counselor. Ask an attorney in the state the property is in what the law is there.
