Bad Divorce = Potential Deal
Hi All!
This is my first time on Bigger Pockets and my first post.
I have something on my hands that could be potentially a really great deal, but it has some complications that go beyond my expertise. I need some help.
Here's the situation:
My coworker is going through a bad divorce. Her soon-to-be-ex-husband has abandoned her and is basically self-destructing. She has been left with all the bills and been court ordered to sell their home. She has moved out already and cannot pay the mortgage anymore. She wants to get rid of the house, but her ex is not being cooperative whatsoever. He is in and out of jail, homeless, on drugs, doesn't have a job, no phone, etc. I've suggested a POA form, but it is very unlikely that he will sign it. The court order is extremely vague and does not give her power to be the sole signatory. Does she have any options? What can she do to sell the home despite her ex's attempts to thwart her? The bank will begin foreclosure processes on Oct 5.
Does she have any options to sell her house without the cooperation of her ex?
