Oregon Auction.com & Zillow advertising w/out homeowners consent

So, I'm a Realtor in Oregon and I just realized Auction.com and Zillow are advertising pre-foreclosures/foreclosure  properties with actual pictures of the house that is still owned by the homeowner until sold at auction...Is this actually legal for them to do?  In Oregon the home owner has title the bank has a note and Auction.com and Zillow are just 3rd party companies... Seems to me they are violating the "Statute of Frauds" in OR. by advertising a property with out the written consent of that home owner to do so...? I do get the NOD is public knowledge but Taking an actual picture of a home for public use in the advertising of the Default should have the written consent of the Home owner until the property becomes an REO....Right?
