Title Insurance Claim - Master HOA Not Disclosed

Justin Wong
Posted

Hello BP,

First off, thank you for all the knowledge shared on this site.

My question is regarding making a title claim. When I purchased my rental property a year ago, the seller failed to disclose the existence of a master HOA. Only a junior HOA was listed on the disclosure report. Additionally, the title commitment report did not identify a master HOA either. Fast forward a year, the master HOA served me a notice for failure to pay my assessments and they put a lien on my title and my case has been turned over to the collections attorney. Now, in that year since i purchased, i've never received a bill from the master HOA or has my tenant mentioned anything about receiving my mail(not the tenants responsibility). I knew about the junior HOA and have been paying my monthly assessments. I genuinely had no idea there was a master HOA. If i did, I certainly would have paid the assessments.

My question is do i have a case to make a claim with the title insurance company?

Thanks,

Justin
