Why dont wholesellers get licensed?

Ive been reading many topics on this forum since i was introduced to it, and one of the big debates is whether or not it is legal to be a wholeseller.

On one side people say “you are not selling real estate, you are selling a contract”

Others say it is illegal because it is the intent that matters.

So my question is: why doesn’t a wholeseller simply get licensed? Problem solved?

I don’t get it. Please help me understand.

@Pavel Shemyakin I was a licensed agent in the past. I gave up my license as I could not stand the bureaucracy and formality for the sake of formality.  EX: In MD not most brokerages now give the buyer a two page form, to tell them they are legally entitled to get a 4 page form.  I not only find that stupid I find it unethical. It overwhelms the consumer so nothing get disclosed as no one reads it. 

In areas with expensive properties there is no reason not to be an agent. (Unless you are a curmudgeon like me)  But on a $75k or less house a 2% commission after the Brokers cut is just not worth the work.  Yet no one is going to pay a 15% commission to make it worth while. 

If you try to "Wholesale " as an agent you are likely breaking a fiduciary duty or at least a duty to deal openly and honestly with the public.

Of course the number one reason is so many Gurus out there saying it is easy, can be done with no money and has not risk. All of which a deliberately misleading.
