I think my seller might have signed two contracts.
I have a contract with a seller for their property. I have opened escrow and my Title Company is moving forward. This is a cash transaction with closing Dec 27th per seller request. In conversation with the seller today they said another investor told them they had an agreement to buy the house. I asked the seller if they signed a contract. The seller said they didn’t sign a contract. Before I got the house under contract, I recall them telling me they were talking to me and another buyer, but elected to go with me. I didn’t think anything of it until the comment today. They reiterated they only want to sell the house to me. What if the seller has a contract with another buyer? They said they didn’t sign anything to sell their house and want to sell it to me. What is my exposure if I end up buying the house (with clear title / title insurance)?
