Getting Title Without Probate?
I'm buying a property where the owner, whose the daughter and sole child of the original owner, inherited the property from her Father via will. She herself died a few years later. House is in NJ but the daughter died as a resident of NY. She in turn left the house to her good friend (again via a Last Will & Testament). Her estate was probated in NY. But NJ wants us to do an anxillary probate in NJ. Problem is that NJ wants an original death cert of the daughter. Having trouble getting it because the friend/exec of daughter"s estate no longer has it (daughter died back in 2002 and everything was settled back then). Trying to get it from the NYC Dept of Health but the Exec. no longer has valid ID. She's a Canadian resident and elderly. I'm prepared to go up there and assist her in getting new ID but I'm wondering if there's an easier way.
Is there a way I can get title to the property and bypass probate while still ensuring marketable title?
