Potential deal with failed underground oil tank
Hi BP,
Has anyone purchased a house with an existing spill violation for an underground oil tank?
I have a potential house with an underground oil tank that was previously tested and failed by a potential buyer. That buyer backed out but the spill is reported to the DEC.
So now the house is flagged with a failing tank and the seller does not have the money to remediate. The cost of removing the tank does not concern me, but the potential of the spill spreading into nearby water tables does.
I know there is a big risk associated, but with a big enough discount is it still worth pursuing? Has anyone structured a deal like this?
