Real Estate Auction question

If, at a Real Estate auction the seller reserve is not met and terms are not reached for the sale that evening or shortly after, does the buyers premium become negotiable? Or even no longer viable? The listing agent on the MLS is the same as the auction company, so they are indicating that auction rules still apply. I ve never gone this route before so I thought I d throw it out to the BP crowd. Thx!!
