(PA) Deal structure offer on house with shady property line fence

Hi BP, I'm looking at buying a foreclosure in my area that I toured and looks great.  My question lies in the driveway of the home.  Its narrow... maybe 15' from house to house.  The driveway of the house of interest goes right up to the foundation which is fine.  One the other side, theres about a 2' space of grass between the driveway edge and the neighboring house.  The neighboring house appears to have installed a brand new chain link fence about a 1' into the driveway of the house im interested in.  Making the driveway virtually unusable as a driveway eliminating any real off street parking for more than 1 car.  I'm guessing he took advantage of the house being empty and is trying to claim his property line.

How would you structure an offer/deal based on this?

I'd like to put an offer contingent upon an acceptable survey.  If the offer gets accepted, I plan on visiting the house and asking the owner personally what the situation is before moving forward even with a deposit. 

Thoughts?
