Question about Land Trust in Nevada
I currently have an accepted offer to buy a property in Las Vegas from a seller that is holding his property in a Land Trust. I've bought several properties from trusts before, so I didn't think much about it at the time. I sent all the paperwork off to my title company today, but got a call this afternoon with some bad news.
According to my escrow officer, they can't get title insurance issued on a property which has been held by a land trust in Nevada. The reason they gave is that land trusts aren't legally recognized in Nevada and they lack the public records to solidify a chain of ownership.
While this wouldn't affect our ability to gain title to the property, we plan to rehab and sell this home. We wouldn't be able to sell it conventionally without title insurance, so I was wondering if anyone else has experienced this problem and how they got around it? I currently have questions out to my RE Attorney and a second title company, but hoped I could get some perspective from someone with experience here.
