Tenants Deposits

Hello everyone,

I'm in the middle of what is a strange situation and I wonder if anyone can provide me any clarity on the issue. I am buying my first home, it is a duplex, we are closing in about a week. I am the buyer and agent. Currently the property has tenants, there leases run out at end of September for unit B and end of October for unit A. In any case, the current owner is holding combined deposits of $1950.00. As of last night, they are trying to maneuver a way not to provide me the deposits. They are claiming that it goes against FHA rules thus "illegal". Can anyone help me with this because it seems as if they're hiding behind legality to keep what is rightfully not theirs to begin with?
