How to put in an offer for an LLC
Hi! I'm a real estate agent (in New Jersey) and will be submitting my first offer on behalf of an investor using an LLC to purchase the property. I want to make sure I fill everything out correctly. DO I use the LLC's name as the buyer? Who signs? I believe it should be one of the co-owners or designated representatives for the LLC, but how do I explain who that is on the contract? Any and all input is greatly appreciated!

Hi Jenine. In the case of an LLC, I list the name of the entity. For example: Utah Hotel Investors, LLC. An authorized signer of that LLC (usually one of the LLC managers) can sign in behalf of the entity. I would consult with the managers of the entity to understand who is authorized to sign, etc. This information will usually be found in an operating agreement. Again, just communicate with them to find out. You may need to produce some documentation from the operating agreement or something to send in with the offer as proof of the signers authority to sign. Good luck with this transaction!
