A few newbie questions - trying not to get analysis paralysis

All of this is brand new to me, but I've been soaking up as much as possible thru podcasts, books and stories in the last few weeks. A few questions that I don't want to get bogged down too much on, but do want to be wise are:

1. LLC - is it necessary/recommended (in Texas) for first time wholesale or fix and flip?

2. Contract - do I use the standard 1-4 TREC contract or does someone have a sample to see?

I've had a million and will continue, but I'm eager to actually get started without sweating stuff too much early...I learn best that way. I've pretty much set my wife up that we may pay for an education - cough "lose money - on this first one. Just don't want to lose my shirt doing something with larger legal issues.
