Seller wants out agent stopped communicating
In escrow for a house which is rented. According to seller renter had not been paying rent. Contract states that property is to be sold vacant and loan terms are owner occupied. Buyer gave thirty day notice to tenant after being in escrow for almost thirty days. Since they would be unable to conform with contract specifications to inspect vacant property five days prior to close, buyer attempted to tie monetary consequences to late closing which would cover buyers rate lock. Seller did not respond. Seller issued notice to perform to remove loan contingency. Agents from both sides spoke on the phone and buyers agents proposed extending escrow time and allowing change of lender if renter did not leave in time. Sellers agent said they would discuss with seller and respond. Without answering back seller had escrow issue cancelation of escrow. Buyer removed all contingencies and informed escrow she wasn't signing cancelation. Sellers agent will not respond to communication. What options do I have to enforce sales contract?
