Would you buy a property with active builder defect claim?

Hello Guys,

I am looking to buy my first home/investment property. I am from Colorado and found a few good deals on townhouses in Denver- Green Valley Ranch neighborhood. The only problem with those properties is that the HOA is during a lawsuit with the developer over builder defects. How risky is buying such property? What might be the potential repercussions? Does anyone know the status of the lawsuit between MSIHOA and developers Green Valley Ranch?
