Right of First Refusal (ROFR) in Florida
Hi BP Community,
Can anyone with experience in the state of Florida advise if the current tenant of a property I am trying to buy has the right of first refusal (ROFR)? Here is the case.
a) Property is off market. Lead was generated via direct mail to absentee owner, who called me back showing some motivation to sell;
b) Property is currently rented and lease term is March 2016;
c) My offer will be all cash at discounted price (with option to assign the contract).... Here is my concern: I've read that ROFR would give the current tenant the ability to buy at the same terms as my offer. Negotiating a discounted price could enable current tenant to match my offer.
d) I have no interest in not renovating the lease with current tenants, in case I end up actually buying the property (and not assigning the contract)
Any advise is welcome.
