Who's yard is this in?

The home next to me is vacant. There is no property marker on the curb. Without having a survey done I am assuming this dead tree is on their end. That or their fence was built on my side of the yard. Now it looks like just a small portion may be on my side. Every week this tree dies more/leans more. I'm trying to figure out when it does fall who's responsibility it is. Or If I can get the bank to take care of it before then. Tree leans toward the vacant homes yard/driveway so I don't think it would hit anything.
