Probate?

I've had a a property fall on my lap that is in probate. The gentleman's brother died and inherited his property. The property is currently in probate for 4 months. Can I take possession of this property during the probate period or should a write a option contract to lock up the property until the end of the 4 month period? Thanks for your time!

You may make a contract with the heir(s) before, during, or after the probate.  Once in contract, I sometimes give the heir(s) some advance money, as part of the purchase price.  If the estate is cash poor, this helps greatly, in order to have my low offer accepted.
