Getting a contract with a FSBO

I am looking to make a deal with a FSBO and he seems to coming down to meet my price. My worry is he seems jittery and I would have at least a month before closing. I will be giving notice on my apartment and won't have a place to life if he backs out. Since i've never closed a deal like this without a realtor my questions are.

1. Can I use the TREC one to four residential contract for Texas even if i'm not a realtor

2. What would be the best way to approach this so that he can't back out and I will have some recourse if he does.
