fill out California Spousal Property Petition form

The property ( the land lot value of $10,000) was held by a single man in 1968.
Later he got married. Passed away in 1980. Now his wife needs to transfer this property under her name. Does she need to fill out California Spousal Property Petition Form DE -221 or she should do Small Estates Probate DE -160 and DE 161 Forms?
