Here is how I handle drafting contracts.
1. Get a generic boiler plate contract that is state specific to where you are doing business. (Board of Realtors etc.) Highlight the clauses & language what you need & like. Strike the ones that you don't like.
2. On a separate sheet of paper, brain storm all your concerns & needs the you want the transaction to fulfill.
3. Rank them in importance. 1-10
4. Edit the draft of your contract to no more than 3 pages.
5. Pay for a few hours of a referred attorney who specializes in these type of transactions, especially if they or their firm has litigated many cases in the area you are focusing on. Have them review your draft & make suggestions for changes.
6. Create a draft, no more than 2 pages.
7. Have a person as similar as possible to those you will be optioning land from (professionals, mom & pop, ranchers, etc.) Ask them if to read it & explain to you what it means.
8. Edit the contract to the point where they lose that confused look from all the legalese your attorney suggested.
