RV Park Deed Restrictions
I'm looking to develop an RV park in Texas. We've found the ideal piece of land and everything looks good; however, the listing agent informed me there is deed restrictions preventing the development of an RV park or mobile home park. Problem is, I asked for a copy of the deed restrictions, in which she provided, and they're from the 1970s. The people listed on them that serve as the "commission" are all dead. There are no signs of more recent deed restrictions. I still need to talk to the city planning department, but it appears the land is zoned correctly for an RV park.
So a couple questions...
The restrictions have a process to request an exception, has anyone had any luck getting exceptions to deed restrictions?
Would a real estate attorney be a good place to start? Is this something in their realm?
