Probate Granted to sell real estate
Question ?? There is a home the has been granted the sell of real estate through probate court. The are two heirs in the property that has been served by the court that they are not legally to stay there after the property have been sold.The house is under contract and the heirs are refusing to let me see the property during my due diligence period.How can I fix this situation. Will the heirs be classified as squatters or is this trespassing. The heirs inside the property are not the executor of the estate

And sadly, sometimes the realty of the situation is they have no where to go and no money. Possibly if they inherit once the estate is settled they can afford to go. You should make sure that probate is up to date on the utilities when you close for the house.
