contractor madness

I hired a contractor to instal 1100 sf of tile because the Store where I brought the tile suggested him to do the job. After he started the work I noticed that he would leave my job for hours than come back and try to lay tile as fast as possible.

This morning (11 am) I went to the house and he was not there working when he supposed to be doing the work. I called him and was told that he would be there at 1pm. I went to the house to see what he had done. The job was wrong. He put the tile wrong and lost 300 sf of material. I called him and told him that he was fired. He said I am coming to pick up my check. I said NO.

He showed up 3 hrs later with his wife and started to scream in front of my home. I ignored and he called the police who laugh at them and totally agreed with me to not pay him. They said that the job was horrible and I would have to take all that tile out spending time and money.

The contractor said he is suing me. Do you really think it is possible when he did not even have a contract . I know its crazy but I did not make up a contract because I was so busy in this fix up home that was so damaged. I am worried that he may come over and try to vandalize my home. The police gave them a no trespassing.

HELP??

If no contract I would not worry too much. My advice document and photo everything right now! Document the times he was there, or not there. Document what was wrong and photo it. Did you get a police report? If so save a copy and don't worry. Hope he goes away and if he doesn't talk to the manager at the tile place "madly". You may get some free tile!
