Are they my tools now or not?

I had contractor put a fence up,he didn't finish and also left his tools in my garage now I gave him 100$ with no signed contract it was verbal now the fence isn't up,I gave him 100$ and now he wants his tools back after 4 month or he's making a police report ,my question is can he sue me and get the tools back and not finishing my fence?
