Improper Roof Installation -- what now?

Hi everyone. I have a legal question regarding the installation of a new roof on one of our rentals in Cincinnati. We had the entire roof replaced in May this year. Since then, we've had issues of leaks and gutter overflow problems. I've had three other contractors look at the roof and all of them have said it was improperly installed, including some code violations. In order to prevent further damage, we're looking at doing the same replacement all over again, only 6 months later! Initially, we worked with our insurance to cover part of the first roof repair. So now, we'll have to pay 100% out of pocket. I really don't trust the contractor we worked with in the beginning to ever touch the roof again, so that is not an option. Can we make that contractor liable for his poor work? Would this hold up in court? What would you do? Thanks in advance!
