Mortgage with Tenants

First-time home buyer. I am interested in purchasing a 2 family home that currently has tenants in both units.  I want to move into one unit and keep the tenants in the other unit.

Does my unit need to be delivered vacant at closing or can I ask the tenants to leave post-closing? If the former, it will obviously extend my closing time. I've read that some mortgage lenders will not close the loan unless the unit is delivered vacant. 

What if the tenants refuse to leave? What are the landlord/tenant rights in Jersey City? 

Any insightful feedback would be greatly appreciated.
