Seller Agent Nightmare

So we found a property that we liked listed at 137k,  the property is no where near worth that much in current condition.  We offer 88k and not only do they reject the offer, they don't counter and pull the listing.  Fast forward 5 weeks they relist the property at 95K at 9pm, we come in at full asking at 9am the following morning,  2 days later we get an email yes we accept your offer if you accept our terms.  17 minutes later we respond yes we accept your terms.  2 days after that they get in touch with our realtor and say that in that span of 17 minutes they had another offer and that we need to submit a best and final offer by 2pm the next day,  we come back immediately with an offer.  it has been 2 weeks now and the seller agent will not counter or respond to our offer saying they are still considering all offers and will not give us a timeframe?  this is a bank owned property in NY State that has been for sale for well over a year.  Do we have any recourse other than to rescind our offer and just find another property?
