Selling Agent Ethics

My Buyers agent and I spent the past few weeks hammering out a purchase on a SFR. Our offer of $64,000 was accepted last week and a contract was sent to the selling broker with the agreement that at closing the owner would pay the bill for foundation repair. We decided after advice from an attorney, the selling brokers attorney in fact, to deduct that cost from the sales price thus taking the owner out of the fold, making it cleaner. The new sales price of $58,400 was agreed on and a new contract sent out late Tuesday. My agent could not get his calls returned nor did he see the ratified contract returned Wednesday. Thursday morning he got word from the selling broker that they accepted a higher offer.

Now my question is, was anything done below standards, unethically or illegally on the end of this selling broker? If so what action can I take and would it net any result?

This is something I haven't come across before and I'll get over it and move on, but I'm slightly po'd to say the least.
