Is it OK to do subject to investing as a licensed real-estate agent?

It's not illegal if that is what you are asking however some would argue there are some ethic and agency issues at play being an agent doing sub2 deals.   My attorney told me that if you are targeting non listed properties,  that there is no fiduciary responsibility however there is an ethical responsibility. You have to remember as an agent you are held to higher standards and if a home owner feels as though they were taken advantage of (especially if payments aren't made after the transfer and the house forecloses)  then it would be safe to say you won't be an agent any longer.  Personally I would talk to my broker get their opinion on it and see what they say as well.  Remember you work for the broker so they may have an issue with it.
