Property without an estate should I buy / get it on assignment or niether? Help!!

Great minds I need your help! I am newbie with investing and I am just generating leads. I have a lead where I was contacted by the son of a lady who passed away without a will and he has not gone through the proceedings to become the executor of estate. He is living in the house which is in foreclosure. The sheriff sale has already passed and the redemption period is up in about forty days. He is willing to sell the or assign/quit claim deed the property to me.. Question is can this be done as there is not an executor of the estate appointed? Also the property was purchased back by the bank for $173k at the sheriff sale. Its a two bedroom, I can get $900 per month on rent... current market value if I fix and flip is about $69k.. What can I do if anything. Please help any advice?
