Chances are you'll register your company name with the state/county/whatever in which you live and license your business. They won't register the same name to someone else operating in the same industry.

@Jason Hendrickson is spot on. Company names are on file with the state and you actually have to check with them to see if your chosen name is already taken. Please note if you choose one that wont prevent other states from issuing the same name as well.
