Short Sale dead end?

Hi everyone! I've been reading about short sales and learned that there is a way to break through those. I found one that sparked my interest, but what it seems like now it's a dead deal, until they foreclose... Or is it? So the property is owned by BoA... Current value is approx $375k (Zillow) they are asking $365.. But it needs at a minimum of $40k in repairs... The place is ok from the outside but is a mess from the insight. All offers below 360k got kicked out (at least that's what I was told. The realtor is assigned to this one, and he is saying its a no-go... Weird... Is there really no way to work this out?
