1031 ownership of Replacement property

Hello

Hope you can help with a technical question about 1031 exchanges.

Does anyone very familiar with 1031 exchanges know what IRS considers having rights of ownership in replacement property that is considered sufficing the 180 day time frame to own replacement property?

Does the deed need to record or can it be the date

you sign deed of trust?

Running into the 180 day deadline and the documents will be signed in time but record 1 or 2 days after deadline!

Help!
