If they move out on the 10th of the month, they've lost the security deposit and have paid for the full month and as soon as i can get someone in there, i either collect double rent or at least am covered for the rest of the month they moved out plus a whole other month.I don't think i would charge them through the remainder of the lease if they moved out a few months early but may have to evolve my thinking there.

We've been lucky enough to only have one property fall out of contract the rest have all made it closing...Not to say there weren't any bumps along the way but very curious to hear why.Thanks again for sharing.

No doubt you're correct that you can do a better monetary job on behalf of your client with a Retail Use/Occupancy, but you also need to consider the rest of the fiduciary duty: There's much less accountability, stress, concern on the part of a warehouse owner than a retail owner.

Prepayment penalty and interest arrears

Of course this is assuming no sneaky unpaid interest clause is in the loan despite a "no prepayment penalty" statement.My second question is this:If I make my normal payment of $1500 on the 1st and I decide to pay $1000 on the 15th of the same month, the lender would bill for interest in arrears (interest accrued from the 1st-15th) before directing the rest of the $1000 to principal right?
