It does seem like that could be a liability that I hadn't even consideredA downside to wood/vinyl is that if you already have concrete subfloors then you're talking a savings of hundreds or thousands of dollars by just finishing the concrete versus putting something on top of it.

As others have said Happy clause is always an option but if the tenant refuses you need to protect your downside and have him sign an addendum about this issue to help protect you down the road should be bring it up again.  

The obvious downside is the limited ability from a PR to act during the time prior to the Hearing on the Petition for Order for Final Distribution.

My biggest downside here is if the church can't make the payments, which is not unlikely, and will this person be willing to foreclose?
