You have to issue a 30 day notice before you file with the court, it takes around another 30 days to get your court date (60 day no rent on top of how many days it took you to decide) and if you don’t find him it is against the law to enter the unit and remove his personal items without his permission.

Don't get a lawyer that would be foolish frankly. read your purchase contracts most of them have mandatory mediation.. but even that will cost you 500 to 1000..what usually happens in these cases .. is the money sits there and then the title company interpleads it with the court..EM cant be released without mutual consent.. you can try small claims court..
