You have to be resolute in this matter or the judge will be forced to agree with the other side.My best advice going forward so this does not happen again: Do a video walk through with your phone with the landlord/property manager when moving in.

I've posted the relevant MA law many times in the forums, but you can read it for yourself here: https://malegislature.gov/Laws/GeneralLaws/PartI/TitleXVI/Chapter112/Section87PP It defines what kinds of activities require you to be licensed.The only legal way to wholesale without a real estate license in MA is to "wholetail" - meaning that you buy the property (presumably at a meaningful discount), add your markup and then re-sell it.

It's somewhat similar to taking over an occupied unit - you usually have no real evidence of the condition of the unit when the existing tenant moved in, so you do the best you can with what you have.Whenever possible, I'm a big fan of documenting the condition of properties with video and then uploading it to YouTube for future reference.
