Can it be amended and the brother buy in as a limited partneron  the original llc that performed the 1031?

You have to put a lot of faith into a company and reputations, proof of performance and specific systems or processes for consistently hitting expectations are all requirements in my opinion if a company wants to earn business.  

Landlords mistakenly ASSUME all PMCs offer the exact SAME SERVICES and PERFORM those services EXACTLY THE SAME WAY, so price is the only differentiator.So, the first question they usually ask a PMC is about fees - instead of asking about services and HOW those services are executed.This also leads them to ASSUME simpler is better when it comes to management contracts.

Talk is cheap afterall.And my concern with having the seller's agent draft a purchase and sale agreement is that they would think that they are then representing me (and receive a commission as such) which i do not want them to.

Otherwise, I never found a deal on loopnet where the asking price was right nor where I could make a good profit.Is is absolutely imperative that you have a broker represent you, but always remember that even your own broker is not going to tell you the downside of the deal since your own broker would lose out on a huge commission.

My impression is that this agent is interested in representing both sides of the deal.
