Attorneys are conscious of this, and do not want to get on a judge's bad side representing a client that may technically be owed a fine, but is behaving opportunistically, and taking advantage of a landlord that didn't do anything to hurt the tenant in any material way.

If she didn't have a guilty conscious she would have signed the lease and been done with it...Being as I still do not have a signed lease, my question is -- if by the end of the month I still do not have the signed lease, according to her previous lease, her contract will go month-to-month and either tenant or landlord can give a 30-day notice to vacate.

You also need to ensure there is room for the new staircase; we ended up moving a couple of walls and reconfiguring the layout of the main floor to fit them in, but this isn't easy in a small house.
