I would bet that most states, when confronted with a factual scenario where a money judgment lien is perfected in the gap (after notices to junior lien holders are sent by the foreclosing lender, but prior to the auction sale) hold that the judgment lien is extinguished as to a bona fide purchaser regardless of whether actual notice of the sale was received.

I personally believe this would be a mistake, with a few minor exceptions.Exception one: I bought a home a few years back that only needed about $20k in rehab so it was very light work for my area, kitchen was perfect and area was fantastic.

The judgement debtors never "perfected" their lien but the title company says they "might" come back 1,2,or 3 years from now and try to put lien on property, therefore, they won't issue title insurance.
