There are many that specialize in lending to non-owner occupied investors on buy & holds or flips. 

They are typically called Non-QM loans.

If using a lender this is a non issue.

FHA is a non-brainier way to go for 4 units or less. 

The first thing I would consider before suing a former tenant is what is the likelihood that I can get the tenant to pay a judgment against them if I win? 

Do you just tell the tenant that you have a space they can live on the cheap, no credit check, no background check, LL can raise rent whenever he/she wants, and you need to leave with 30day notice?
